Senior Advocate of Nigeria and legal scholar, Oyetola Muyiwa Atoyebi, SAN, FCIArb (U.K.) (Notary Public), has highlighted the critical role of whistleblowing in strengthening Nigeria’s fight against money laundering and other financial crimes.
In an article titled “Whistleblowing as a Tool for Combating Money Laundering in Nigeria: Legal Protections, Risks, and Effectiveness,” Atoyebi examines how whistleblowing has become an indispensable mechanism for exposing illicit financial activities that often remain concealed from regulators and law enforcement agencies.
According to him, money laundering continues to pose a serious threat to Nigeria’s financial system by facilitating corruption, terrorism financing, fraud, and other economic crimes that weaken public trust and undermine economic stability. He notes that as financial crimes become increasingly sophisticated, empowering employees, consultants, and other insiders to report suspicious transactions is essential to promoting transparency, accountability, and effective anti-money laundering enforcement.
The article analyses Nigeria’s legal and regulatory framework governing whistleblowing, focusing on the protections and incentives available to whistleblowers. It also identifies major challenges limiting the effectiveness of the system, including inadequate legal safeguards, fear of retaliation, low public awareness, and weak enforcement mechanisms.
Atoyebi concludes that strengthening whistleblower protection laws, improving institutional safeguards, and fostering a culture of transparency and accountability are crucial to enhancing the effectiveness of whistleblowing as a tool for combating financial crime in Nigeria.
