An Originating Summons is traditionally employed to resolve concise questions of law, construction, or interpretation where the facts are undisputed.
Nigeria’s electoral jurisprudence, however, operates within a uniquely compressed timeline for pre-election disputes, which courts consistently treat as sacrosanct, leaving little room for extension or procedural indulgence.

This framework is designed to preserve electoral certainty, avoid lengthy litigation, and resolve disputes before elections.
This article argues that the mandatory commencement of all pre-election matters by Originating Summons is not only justified but also necessary even where factual controversies may arise.
