The President of the Nigerian Bar Association, Oyinkansola Badejo-Okusanya, SAN, has been appointed to an ad hoc Body of Benchers committee to examine issues arising from appeals against decisions of the Legal Practitioners Disciplinary Committee.
The appointment followed the NBA President’s first Body of Benchers meeting in that capacity on September 17, 2026. According to an official NBA statement published Friday, the committee is expected to consider the implications of the Supreme Court’s recent judgment in Ben Mene-Ejegi v. Nigerian Bar Association & Legal Practitioners Disciplinary Committee.
The Supreme Court held, by a five-to-two majority, that LPDC decisions cannot proceed directly to the Supreme Court, finding Section 12(7) of the Legal Practitioners Act unconstitutional to the extent it purported to create such a direct appellate route. The judgment, makes the Court of Appeal the required intermediate appellate court.
The Body of Benchers committee will be chaired by retired Supreme Court Justice K.B. Akaahs, with former NBA President J.B. Daudu, SAN; Professor Dakas C.J. Dakas; and the NBA President among those expected to consider the professional and regulatory consequences of the decision.
