Court Dismisses Nnamdi Kanu’s “No-Case” Submission, Orders Him to Enter Defence

The Federal High Court in Abuja has dismissed a “no-case” submission filed by Nnamdi Kanu, the leader of the proscribed Indigenous People of Biafra (IPOB), and directed him to enter his defence in the ongoing terrorism trial.

Presiding over the case, Justice James Omotosho held that the Department of State Services (DSS) had made out a prima facie case against Kanu through evidence presented by five prosecution witnesses, warranting that he respond to the charges. The court emphasised that dismissing the case at this stage would be premature. Justice Omotosho clarified, however, that the decision to overrule the “no-case” submission does not amount to a finding of guilt.

During the ruling, the judge adjourned the matter until October 8, 2025, for the report of a medical panel appointed by the Nigerian Medical Association (NMA). The panel had been ordered to examine Kanu’s health and determine whether he should be moved from DSS detention to the National Hospital for treatment.

In response to the court’s directive, the NMA formed a committee of medical specialists from the seven geopolitical zones to examine Kanu’s health, focusing on specialties such as neurology, ophthalmology, urology, gastroenterology, among others. The report has since been submitted to the Attorney-General of the Federation (AGF) for consideration.

Kanu has long maintained his innocence and challenged the charges, which include terrorism-related counts. The trial has been closely watched nationally and internationally, given its implications for Nigeria’s handling of political dissent and national security issues.
