The Nigerian Bar Association (NBA) has expressed grave concern over the controversies that have emerged in relation to the recently enacted Tax Reform Acts, warning that the developments cast serious doubt on the integrity, transparency, and credibility of Nigeria’s lawmaking process.
According to the Association, these controversies strike at the very heart of constitutional governance and call into question the procedural sanctity that must attend lawmaking in a democratic society.
The NBA considers it imperative that a comprehensive, open, and transparent investigation be conducted to clarify the circumstances surrounding the enactment of the laws and to restore public confidence in the legislative process. It stressed that until these issues are fully examined and resolved, all plans for the implementation of the Tax Reform Acts should be immediately suspended.
The Association further noted that legal and policy uncertainty of this magnitude has far-reaching consequences, including the destabilisation of the business environment, erosion of investor confidence, and unpredictability for individuals, businesses, and institutions required to comply with the law.
Such uncertainty, the NBA warned, is inimical to economic stability and has no place in a system governed by the rule of law.
Emphasising the standards required in a constitutional democracy, the NBA stated that laws, particularly those with profound economic and social implications, must emerge from processes that are transparent, accountable, and beyond reproach. Anything short of this, it said, undermines public trust and weakens the foundations upon which lawful governance rests.
The Association therefore called on all relevant authorities to act swiftly and responsibly in addressing the controversy, in the overriding interest of constitutional order, economic stability, and the preservation of the rule of law.
