The National Industrial Court sitting in Kaduna has declared the dismissal of a public servant identified as Mrs Jummai from the Kaduna State Government service null and void.
Justice Bashar Alkali held that the alleged misconduct relied upon against the claimant did not fall within recognised categories of misconduct under the Kaduna State Public Service Rules and was not founded upon a known law.
The court ordered the Kaduna State Government and other defendants to pay her ₦1.5 million in salary arrears covering July 2019 to October 2020.
It also directed the payment of ₦5 million as general damages for the unlawful dismissal and ordered that outstanding pension contributions be remitted to the appropriate pension fund administrator.
The judgment sum attracts 10 per cent interest until fully paid if the defendants fail to comply within the stipulated period.
The court, however, did not order her reinstatement.
The decision is another reminder that public authorities exercising disciplinary powers must comply with the conditions of service, applicable public-service rules and fair-hearing requirements.
