The Federal High Court in Abuja has warned lawyers representing four defendants in the alleged kidnapping and killing of Department of State Services (DSS) operative Ekpeyong Asuquo Owoh against delays in proceedings.

The warning came during proceedings on Wednesday, October 21, according to a report by Vanguard. The court subsequently adjourned the case to October 28.

The case concerns allegations that Owoh was kidnapped and killed. Four defendants are facing trial over the incident, which has brought renewed attention to the prosecution of violent crimes involving security personnel.

Court proceedings remain central

A court’s warning about delay does not determine whether a defendant is guilty. It reflects the importance of ensuring that criminal proceedings advance without unnecessary postponements while preserving every defendant’s right to a fair hearing.

In a criminal trial, the prosecution must establish the charges with admissible evidence and prove its case beyond reasonable doubt. The defence must also be given a proper opportunity to challenge the prosecution’s evidence and present its case.

These safeguards are especially important in serious offences involving allegations of kidnapping and murder, where the consequences of a conviction are severe.

The next adjourned date, October 28, will be an important procedural milestone.

Why the case matters

Violent crimes involving security personnel raise difficult questions about public safety, accountability and the effectiveness of criminal investigations.

The public has a legitimate interest in seeing serious cases resolved. Equally, justice requires that the court reach its decision on evidence rather than public pressure or assumptions about the defendants.

The proceedings remain ongoing. The allegations against the defendants have not been established by a final judgment in the information reviewed for this report.
