The All Progressives Grand Alliance has approached the High Court of Imo State seeking to stop the local government elections scheduled for September 26, 2026.
The suit was instituted by APGA alongside four officials of its Imo State chapter against the Imo State Independent Electoral Commission, its chairman and the Attorney-General of Imo State.
At the centre of the case is APGA’s argument that the statutory process leading to the election may not comply with provisions governing notices of election, electoral timetables and the Register of Voters.
The dispute relates partly to a notice issued by ISIEC on September 18, 2025, which the commission described as a 360-day Notice of Election.
APGA contends that the document did not state the actual election date. The party argues that ISIEC’s subsequent September 11, 2026 announcement fixing the election for September 26 cannot retrospectively cure what it alleges was a defective notice.
The case has another significant dimension.
The original process began while the Electoral Act 2022 was in operation, but that legislation has since been replaced by the Electoral Act 2026.
APGA is asking the court to determine whether the continuing election process satisfies requirements imposed under the new legislation.
The party has also raised questions about the Register of Voters proposed for the election and is asking the court to compel production of several electoral documents.
An interlocutory injunction seeking to temporarily restrain ISIEC from proceeding with the election was fixed for hearing on September 23.
As of the material reviewed for this report, no court order stopping the September 26 election had been established, and ISIEC’s announced position remained that the poll would proceed.
The litigation is potentially significant beyond Imo because it may clarify the obligations of state electoral commissions under Nigeria’s new electoral legislation.
