Court Dismisses Gachagua’s Bid to Halt Impeachment Process

A three-judge High Court bench has dismissed Deputy President Rigathi Gachagua’s bid to stop the Senate’s ongoing impeachment process against him.

Justices Eric Ogola, Anthony Mrima, and Freda Mugambi ruled that Gachagua’s request was premature, emphasizing that the court could not intervene in a process that is still underway. They noted that Gachagua would have the opportunity to seek legal recourse if he disagrees with the Senate’s decision after the proceedings are concluded.

“We cannot anticipate the outcome of a process that has yet to reach its conclusion,” the judges stated, adding that the Senate’s impeachment process is a constitutional procedure and should be allowed to proceed. They assured that Gachagua would not suffer any harm by allowing the Senate to fulfill its role.

The court highlighted that the issues raised by Gachagua had already been addressed in a separate ruling by Justice Chacha Mwita, who also refused to halt the impeachment proceedings on Tuesday.

Justice Ogola, delivering the unanimous decision, explained, “This case does not justify immediate intervention. Upholding the separation of powers requires us to refrain from intervening at this stage, allowing the constitutional process to unfold.”
