Nigeria’s Cyber Law Debate Deepens as Retired Judge Warns Virtual Space Is Becoming a Lawless Arena

Retired High Court judge and Visiting Professor Justice Alaba Omolaye-Ajileye has called for a stronger legal response to cybercrime and online misconduct, warning that the virtual environment is exposing major gaps in Nigeria’s justice system.

In a recent intervention, the retired jurist described cyberspace as increasingly difficult to regulate because online conduct can cross jurisdictions instantly while law-enforcement structures remain primarily national.

He identified concerns around criminal intimidation, online harassment, impersonation, cyber fraud and digital threats, arguing that traditional legal concepts are being tested by conduct that may originate outside the jurisdiction in which the harm is felt.

The challenge is not merely technological.

It also concerns evidence, attribution, jurisdiction and enforcement.

A threatening message may be sent from one country, routed through servers in another and received by a victim in Nigeria.

That raises immediate questions over which court has jurisdiction, how the identity of the sender is established and whether digital evidence can be preserved and authenticated.

Justice Omolaye-Ajileye’s intervention adds to a wider national debate around the balance between regulating harmful online conduct and protecting legitimate freedom of expression.

For lawyers, the subject is becoming increasingly important because cybercrime cases now sit across criminal law, constitutional rights, evidence, privacy and technology regulation.
