Lagos Court Acquits Two Men of Land Theft, Forgery Charges

The Lagos State High Court has discharged and acquitted Lawal Ige and Ajiboye Ayinla Iroko on charges connected with a disputed 10.503-hectare property.

The prosecution had alleged offences including conspiracy, stealing, forgery, uttering false documents and procuring documentation through allegedly false representations.

The dispute concerned land in the Alimosho area of Lagos.

Justice Olubunmi Abike-Fadipe examined the prosecution’s evidence and ultimately held that the criminal allegations had not been proved beyond reasonable doubt.

The decision highlights an important distinction frequently encountered in Nigerian property disputes.

A contest over ownership or competing title documents may create civil liability or justify a civil action without necessarily establishing criminal responsibility.

Where prosecutors allege forgery, stealing or fraudulent procurement of documents, they must prove the specific elements of those offences against each defendant.

Suspicion arising from conflicting claims to land is insufficient by itself.

The prosecution must establish the alleged criminal conduct through admissible and convincing evidence.

The acquittal therefore does not necessarily amount to a general declaration resolving every possible civil ownership question surrounding the land. Rather, it means that the criminal case brought against the defendants failed to satisfy the evidentiary burden required for conviction.

Property litigation remains a significant source of legal disputes in Lagos, where rapid development and rising land values have intensified conflicts involving title documentation, family ownership, developers and multiple sales.

For purchasers and investors, the case again underscores the importance of thorough title investigation before committing funds to land transactions.
